Why This Matters.
A Legionnaires Disease Risk Assessment is a legal obligation for all landlords under the Health & Safety at Work Act (HSWA) & Control Of Substances Hazardous to Health (COSHH).
Under this legislation, Landlords have a duty to protect their tenants from biological agents.
In a domestic property, the risk of contracting Legionnaires Disease is quite low. It does happen and it has been fatal, but it is rare!
Leptospirosis, Norovirus & Giardia on the other hand are also biological agents that can pose a significant health risk to anyone living in the property, and these are far more common in a domestic plumbing system.
Do you have a tenant aged over 45? Do they smoke or have other health issues such as diabetes, heart or lung problems, or are they undergoing treatments that can impact their immune system such as cancer treatments? If so, your tenant has a much higher risk of illness from biological agents.
A professionally prepared Legionnaires Disease Risk Assessment will also identiy areas of your property that fail to comply with current Water Regulations which would increase the risk of these other health hazards.
Failing to provide your tenant with a Legionnaires Disease Risk Assessment could. . .
Void your landlord insurance.
Leave you open to legal claims.
Put your tenants health at risk.
I'm going to take a guess and say you DON'T want a solicitor, or your insurer, informing you that your tenant is making a claim against you and your insurance policy is likely to be void, because you failed to comply with basic Health & Safety requirements.
